I. General Guidelines
Documents: Please ensure that your passport/s and other travel documents such as your visa for the Philippines are valid. It is important that your travel documents are up to date in order to avoid delays in your travel.

Airline tickets: Unless arranged otherwise, Liquid Body Surf Co., sells promotional, bulk, or wholesale airline tickets which are the most restrictive in refundability, transferability, and changeability.Most tickets are non-refundable and non-transferable. Liquid Body Surf Co. recommends purchasing travel insurance in order to protect yourself if you have purchased non-refundable tickets and need to cancel your trip for an unforeseen reason.

Equipment: IMPORTANT- Many airlines charge excess baggage fees for surfboards and other bulky equipment. Some airlines such as United, Continental and Delta most notably have EXCESS BAGGAGE EMBARGOS to many cities meaning they do not allow surfboards at all on the plane during select times of the year to select cities. Because traveling with surfboards has become a complex matter, we urge you to allow Liquid Body Surf Co. to arrange your airfare and NOT TO ATTEMPT TO BOOK AIRLINE TICKETS ON THE INTERNET OR THROUGH OUTSIDE AGENCIES AS THEY WILL NOT TAKE AIRLINE BAGGAGE POLICIES PERTAINING TO SURFBOARDS INTO CONSIDERATION WHEN BOOKING YOUR TICKETS. Liquid Body will ensure that you are booked on a "SURF-FRIENDLY" airline. Please inquire with your Liquid Body agent about the particular baggage policies of the airlines on which you are booked.

Vaccinations: Please consult your G.P. or contact your local Vaccination Centre or check www.traveldocs.com/ph/ for advice on medical and vaccination requirements for your trip.
II. PAYMENTS, DEPOSITS, CANCELLATION/ REFUND AND DISPUTE PROVISIONS DEPOSITS: All deposits and trip payments are non-refundable.Most cancellations due to medical reasons or family emergencies are covered by travel insurance. On some tours we offer "rain checks". This is done depending on the situation.

PAYMENT: Full payment on all Liquid Body Surf Co. tour bookings is required in our offices no later than 60 days prior to departure (90 days on boat charters). Tour bookings made within 60 days of departure (within 90 days on boat charters) require full payment at time of booking.
CREDIT CARDS: For all Liquid Body tours, cardholders must submit a credit card authorization form either online or by fax or mail. We do not accept credit card payments over the phone. We do not accept 3rd party credit cards except from an immediate family member or from a known corporate customer. We accept all major credit cards.
CANCELLATION/ REFUND POLICY: Surf tours, resorts,  hotels, camps and boat charters are operations for which space is limited and competitive. All Liquid Body suppliers are prepaid 30-90 days prior to departure so that they may begin provisioning for your tour. ALL TOUR PAYMENTS AND DEPOSITS ARE NON-REFUNDABLE. “Rain checks” will be considered depending on the situation if sufficient notice (at least 7 days prior to trip) was received of cancellation. There are no refunds or partial refunds given for early departures from a tour or early checkouts from a resort, hotel or surf camp. There are ABSOLUTELY no refunds given for reasons pertaining to surfing conditions or weather conditions. There are ABSOLUTELY no refunds given for reasons pertaining to a global, national, or provincial political situation that does not directly pose a security threat to the safe operations of the tour in the specific region. For your protection, travel insurance is mandatory with all Liquid Body tours.

DISPUTES: All claims, legal and otherwise, against Liquid Body Surf Co., its officers, directors, agents, employees, affiliated companies, heirs and assignees arising under, in connection with, or incident to this BOOKING TERMS AND CONDITIONS AGREEMENT PARTS I, II AND III, shall be determined according to the laws of Manila, Philippines and shall be adjudicated in the Courts within the jurisdictional geographic boundaries of Manila, Philippines to the exclusion of the courts of any other county, state or country.

In the event that one or more of the provisions of this BOOKING TERMS AND CONDITIONS AGREEMENT PARTS I, II AND III, for any reason, is held by a court of competent jurisdiction to be invalid or unenforceable in any respect, such invalidity or unenforceability shall not affect any other provision within this agreement and this agreement shall be construed as if such invalid or unenforceable provision had never been contained herein.
III. LIABILITIES

Liquid Body Surf Co. shall not be responsible or liable for any death, disability, injury, damage, liability, loss, cost, expense, delay, inconvenience and/or loss of enjoyment which is or may be suffered or incurred by you or any other person or corporation caused or contributed to directly or indirectly by or arising from or in connection with:

     a) any force majeure or other events beyond Liquid Body Surf Co.’s control, including but not limited to war, civil disturbance or unrest, terrorism, acts of government or any authorities, weather, tsunami, earthquake, wind, fire, flood, strikes or industrial action, illegal activities, accidents, failure of transport carriers, machinery or equipment;

     b) the inability of Liquid Body Surf Co., tour operators, charter operators, hoteliers or carriers to comply with any special request relating to age, medical conditions, physical ability or disability, dietary requirements, allergic conditions or smoking or non-smoking accommodation or seating;

    c) negligence by, delay in or cancellation of services or any other act or omission of any airline, charter boat operation, land operator, transfer company or any other persons or company providing goods or services in respect to your booking arrangements; and/or

    d) you or any other person contravening or failing to comply with any laws, notices, instructions, tour information or itinerary provided by any Government, regulatory authority, Liquid Body Surf Co., tour operators, charter operators, hoteliers or carriers or otherwise any other act or omission of you or any other person, including being affected by alcohol or drugs, engaging in dangerous behavior, being reckless, not taking adequate precautions or due personal care or otherwise entering into situations exceeding your or any other person’s abilities.

Liquid Body Surf Co. is an agent for and is not itself an airline, transport carrier, resort or hotel owner or operator, boat owner charter or operator, transfer company or otherwise (a “Service Provider”) and as such has no control over any services or product provided by such Service Providers. You and your travel arrangements are subject to the terms and conditions and limitations of liability imposed by all Service Providers utilized by you, whether or not written notice thereof has been provided or shown to you.
Neither Liquid Body Surf Co. nor any of its representatives shall be liable to you or any other person in the event that, due to any reason whatsoever, satisfactory surf is not available, perceived or expected climatic patterns or oceanic occurrences do not occur, the surf is of too great a magnitude or is beyond your capabilities or comfort zones, or atmospheric or oceanic visibility is impaired or any sporting or leisure activity is too dangerous or is restricted. These matters are solely at your risk and you engage in all activities at your own choice at all times. The Company and its Service Providers are not required to assess or monitor your capabilities or participation in any such activity nor advice or update you on any such matter.
Liquid Body Surf Co. and its Service Providers reserve the right, without liability or right of compensation, to prohibit or restrict any activity, or cancel or alter any service or itinerary, without notice, in their absolute discretion.
It is the responsibility of each Client to check all details of their itinerary against their instructions and advise Liquid Body Surf Co. within a reasonable time of any errors or discrepancies. If Liquid Body Surf Co. does not receive notification of any errors or discrepancies, it will be assumed that all details are correct. All corrections requested not within a reasonable time or after the payment of any trip segment will be treated as a change to the booking and may incur consequential fees.

Liquid Body Surf Co. does not warrant, and is in no way responsible for the accuracy or completeness of any information given or statements made or implied by any employee, contractor, agent or representative of the company or any of its Service Providers.
